These Terms of Use (the “Terms”) form a binding legal agreement between you and TLM Software Design, Inc. (“TLM,” “we,” “us,” “our”), a Michigan corporation with offices at 27280 Haggerty Road, Ste. C-6, Farmington Hills, MI 48331, United States, governing your access to and use of the Ping Network Tool mobile application and the accompanying website at apps.swtlm.com/ping-network-tool/ (together, the “Service”). By installing or using the Service you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement.

2. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the app for your personal, non-commercial network diagnostic purposes. All rights not expressly granted are reserved.

3. Acceptable use

You agree not to:

• Use the Service to probe or stress-test hosts without authorisation from the host operator.
• Use the Service to attack, flood, or disrupt any network, server, or service.
• Reverse-engineer, decompile, or attempt to extract source code from the app except as permitted by applicable law.
• Use the Service to develop a competing product or to train a machine-learning model.
• Redistribute, sublicense, or sell the app or any portion of it.

We may suspend or terminate access for violations of these terms.

4. Free tier and Premium unlock

The app is free to use without a time limit. A single optional in-app purchase of $1.99 permanently unlocks:

• TCP Ping — probe a specific port number rather than ICMP only.
• Unlimited hosts and background monitoring — remove the 5-host limit and monitor as many targets as needed.
• No promotional banners — permanently removes the upsell banner and weekly reminders.
• Family Sharing — the purchase is shared with your family group at no extra cost.

This is a one-time purchase. There is no subscription and no auto-renewal.

5. Refunds

In-app purchases are processed by Apple or Google. Refund requests are handled directly by them under their respective policies:

6. Intellectual property

The Service and all underlying software are owned by TLM Software Design, Inc. and its licensors. “Ping Network Tool” and related marks are trademarks of TLM Software Design, Inc.

7. Third-party services

The app communicates with hosts you choose to test (normal network traffic), api.ipify.org (external IP lookup), Firebase (analytics and crash reporting), and RevenueCat (purchase validation). Your use of those services is subject to their respective terms and privacy policies.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE. DIAGNOSTIC RESULTS ARE FOR INFORMATIONAL PURPOSES ONLY.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLM SOFTWARE DESIGN, INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $50.

10. Termination

You may stop using the Service at any time by uninstalling the app. We may suspend or terminate access if you breach these Terms or if required by law.

11. Dispute resolution

Any dispute arising under these Terms will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Oakland County, Michigan. You and TLM each waive any right to a jury trial or to participate in a class action. You may opt out of this arbitration clause within 30 days of first accepting these Terms by emailing info@swtlm.com with the subject “Arbitration opt-out.”

12. Governing law

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles.

13. Apple App Store additional terms

If you downloaded the app through the Apple App Store, Apple is not a party to these Terms. Apple has no obligation to furnish maintenance or support services for the app. Apple is not responsible for any claims relating to the app. In the event of any conflict between these Terms and Apple’s usage rules, Apple’s usage rules prevail.

14. Changes to these terms

We will post material changes here and update the “Last updated” date. Continued use of the Service after a change means you accept the new Terms.
