These terms govern your use of the Purrhoop mobile game and the Purrhoop website (the "Service"), provided by TLM Software Design, Inc., a Michigan corporation with offices at 27280 Haggerty Road, Ste C-6, Farmington Hills, MI 48331, USA ("we", "us", "our"). By downloading or using the Service you agree to these terms. If a child uses the game, a parent or guardian is responsible for that use and for any purchase.

What the Service is

Purrhoop is a retro pixel arcade game played in 60-second rounds. It needs no account and no internet connection to play. Game progress is stored on your device.

Free play and optional purchases

The core game is free. Two optional one-time in-app purchases are offered through the grown-ups box behind a parental gate: Full Catch (more fish and more looks) and the Supporter pack (everything in Full Catch plus a thank-you to the makers, with no gameplay advantage). Both are non-consumable one-time purchases: neither is a subscription and neither renews. Prices are set by the store and shown in your currency, so they differ between countries. Coins in the game are earned by playing and cannot be bought.

Purchases are processed by Apple or Google, and can be restored on a new device with the same account via Restore purchases. Family Sharing or the Google Play family library applies under those platforms' own rules.

Refunds

Refund requests for in-app purchases are handled directly by Apple or Google under their policies.

Acceptable use

You agree not to:

• Reverse-engineer, decompile or try to extract the source code of the app.
• Copy, resell or redistribute the app or its art and audio.
• Interfere with the app's purchase checks or use it in a way that breaks store rules.

Your data

How the app handles data is described in the Privacy policy. In short: no ads, no advertising ID, no account, and game progress stays on your device.

Intellectual property

The Service, including the game, its pixel art, music and sound effects, is owned by TLM Software Design, Inc. and its licensors. We grant you a limited, non-exclusive, non-transferable licence to install and use the app for personal, non-commercial play.

Service availability

Because the game works offline, play is available regardless of our server status. Purchase checks, crash reports and analytics need a connection but are not required to play.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOUR PROGRESS WILL BE PRESERVED IN ALL CIRCUMSTANCES, FOR EXAMPLE IF YOUR DEVICE IS LOST OR RESET.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TLM SOFTWARE DESIGN, INC. BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) USD $10.

Some jurisdictions do not allow certain exclusions or limitations, so the above may not apply to you.

Termination

You can stop using the Service at any time by deleting the app. No server-side account exists, so there is no account to close. Deleting the app removes your game progress from your device.

Changes to these terms

We will post material changes here and update the date above. Continuing to use the Service after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Oakland County, Michigan, and you consent to that jurisdiction. Nothing in this section waives any consumer-protection right that the law of your country of residence grants you and that cannot be waived by contract.
