Terms of use
Last updated 2026-10-21
These terms govern your use of the Habitile mobile app and the Habitile website (the “Service”), provided by TLM Software Design, Inc., a Michigan corporation with offices at 27280 Haggerty Road, Ste C-6, Farmington Hills, MI 48331, USA (“we”, “us”, “our”). By downloading or using the Service you agree to these terms. If you got the app from the App Store, Apple’s Licensed Application End User License Agreement also applies; where the two differ, these terms add to it rather than replace it.
Who can use the Service
You must be at least 13 years old (16 in the EU and the UK) to use the Service. Habitile is a personal habit-tracking tool. It is not a medical device and does not give medical, health or professional advice.
What the Service does
Habitile lets you create habits with a daily or weekly target, check them off, see your history and streaks in a grid, set reminders, add a habit by voice, and export and restore a backup file. Your habits and history are stored on your device. The Service needs no account, and tracking works without an internet connection. Buying or restoring Premium and loading ads in the free version need one.
Free version and Premium
Habitile is free to download and use, with no limit on the number of habits. The free version shows ads: a banner on the History screen and, rarely, a full-screen ad after a milestone. See the privacy policy for what that involves.
Habitile Premium removes the ads, and unlocks the Paper and Dusk themes (in light and dark) and a matching app icon for each. It is offered as:
- a yearly subscription, which renews automatically, or
- a lifetime purchase, paid once and never renewed.
The App Store or Google Play shows the price in your currency before you buy.
The yearly subscription renews automatically at the end of each year, at the price shown when you subscribed, unless you cancel at least 24 hours before the period ends. Your store account is charged within the 24 hours before renewal. You can manage or cancel the subscription in your App Store or Google Play account settings. Cancelling stops the next renewal, and Premium stays active until the end of the period you paid for.
Purchases are processed and billed by Apple or Google under their terms, and refunds are handled by them. You can restore Premium on a new device from Settings or the Premium screen, using the same store account.
We may offer other optional in-app purchases in future versions. Each is described, with its price, where you buy it.
Refunds
In-app purchases are processed by Apple or Google. Refund requests are handled directly by them under their policies.
- Apple: reportaproblem.apple.com
- Google Play: support.google.com/googleplay/answer/2479637
Your data and backups
Our handling of your data is described in the privacy policy. Key point: your habits and history are stored on your device and are not sent to our servers. That also means we cannot recover them. If your phone is lost, reset or replaced, or you delete the app or use Delete local data, they are gone unless you exported a backup file first. Keep your backups somewhere safe; they are your responsibility.
Acceptable use
You agree not to:
- Reverse-engineer, decompile or attempt to extract the source code of the app, except as far as applicable law allows.
- Copy, redistribute or resell the app, or use it to build a competing product.
- Use the Service unlawfully, or to harm others or infringe anyone’s rights.
Licence and intellectual property
The Service and the Habitile app are owned by TLM Software Design, Inc. and its licensors. We grant you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control. You keep full ownership of the habits and history you enter. Habitile includes open-source software under its own licences, listed in the app under Settings → Open-source licenses; those licences apply to those components.
Service availability
Because tracking works offline, logging, history, streaks and reminders do not depend on our servers. Reminders are scheduled by your device’s operating system, and your device settings, battery optimizations or an infrequently opened app can delay or prevent them, so do not rely on them for anything critical.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT A REMINDER WILL ALWAYS BE DELIVERED, OR THAT THE DATA YOU ENTER WILL BE PRESERVED IN ALL CIRCUMSTANCES (FOR EXAMPLE, IF YOUR DEVICE IS LOST OR RESET). BACK UP YOUR DATA USING THE EXPORT FEATURE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TLM SOFTWARE DESIGN, INC. BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) USD $10.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above may not apply to you. Nothing in these terms limits any right you have under consumer-protection law that cannot be limited by contract.
Termination
You can stop using the Service at any time by deleting the app. Because no server-side account is created, there is no account deletion step. Deleting the app removes the data stored on your device. Cancelling a subscription is done in your store account, not by deleting the app.
Changes to these terms
We will post material changes here and update the “Last updated” date. Continued use of the Service after a change means you accept the new terms.
Governing law
These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Oakland County, Michigan, and you consent to that jurisdiction. Nothing in this section waives any consumer-protection right that the law of your country of residence grants you and that cannot be waived by contract.
