Who these terms bind

Match & Spot is made for children aged 4 to 10, but children cannot enter into contracts. These terms are an agreement between us and you, the parent or legal guardian (or other adult) who downloads the app, hands it to a child, or makes any purchase. You are responsible for your child's use of the app. Purchases, restores, settings and outbound links are reachable only through an adults-only parental gate.

What the Service is

Match & Spot is a puzzle app for iOS and Android with two game modes: memory match, where a child turns over cards to find matching pairs on grids from 2×2 up to 4×5, and spot the differences, where a child finds every difference between two illustrated scenes. Both modes are organised into themed packs, each opening on a grid of levels, share a hint system, and run fully offline: every card set and every scene ships inside the app, and progress and settings stay on your device. The app contains no advertising and offers a single one-time non-consumable in-app purchase, “Unlock everything”, managed by RevenueCat.

Acceptable use

You agree not to:

• Reverse-engineer, decompile or modify the app beyond what applicable law permits.
• Attempt to bypass the parental gate or make the app's gated surfaces reachable by children.
• Use the app in any way that breaks applicable law or the terms of the App Store or Google Play.

In-app purchase: Unlock everything

“Unlock everything” is a one-time, non-consumable purchase that permanently opens all levels in both modes on the purchasing account. It supports Family Sharing, so one purchase covers eligible members of your family group. There are no subscriptions, no consumable purchases and no virtual currency. The price is set on each store's listing and shown to you before you confirm; payment is processed entirely by the Apple App Store or Google Play under their own terms, and purchases are subject to each store's refund policy. Purchase verification is handled by RevenueCat: see our privacy policy for what data that involves.

Intellectual property

The Match & Spot app, its original artwork (card sets, illustrated scenes, pack artwork, icons and UI), its level content and the code that runs it are owned by TLM Software Design, Inc. The underlying game forms, a memory pairs game and a spot-the-difference puzzle, are unprotected prior art. We grant you a limited, non-exclusive, non-transferable licence to install and use the app for personal, non-commercial entertainment.

“Match & Spot” is our brand name for our particular implementation, and its use is not intended to imply affiliation with any other game or trademark holder.

No warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the app will be error-free or that progress will be preserved under all device conditions, although the app is designed never to lose a child's progress.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLM SOFTWARE DESIGN, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR ANY IN-APP PURCHASE IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $5, WHICHEVER IS GREATER. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CONSUMER-PROTECTION LAW GRANTS YOU AND DOES NOT ALLOW TO BE LIMITED.

Changes to the app or these terms

We may update the app or these terms at any time. Material changes to the terms will be posted here with an updated date. Continued use of the app after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts of Oakland County, Michigan.
